Article 1 (Definition)

Under this terms of service, the terminologies described in each of the following items shall be used through the following meanings. “silkroad store” shall refer to the system that publish provided information regarding product or service, or system that has the function to provide product or service through online, and it shall refer to the site operated by our company on internet pursuant to this terms of service.
“User” shall refer to a person who accesses the “silkroad store”.

“Service” shall refer to the service that our company offers to a person using the “silkroad store” pursuant this terms of service, and with regard to the content and type of service, they may be changed, increased/decreased based on our company’s sole decision on need basis, and its notice shall be displayed on “silkroad store” on need basis, or be notified through email or other communication means.

Article 2 (Scope and Change of Terms of Service)

This terms of service shall apply to our company and user pertaining to the use of the service, and the user shall faithfully comply with this terms of service upon using the “silkroad store”.

Individual rules separately being displayed on “silkroad store” or through other means by our company and additional rules being notified to user on need basis by our company shall constitute a part of this terms of service. In the event the individual rules and additional rules differ from this terms of service, individual rules and additional rules shall prevail.

There may be a case whereby our company will change this terms of service based on our company’s sole decision without the consent of the user. In such case, the terms of use of the service offered by the “silkroad store” shall be pursuant to the revised terms of use that went through the change. Said change shall come into effect at the point of making notice to the email with its destination address that has been notified to our company in advance or general display on “silkroad store”, or other notice method deemed appropriate by our company.

In the event the user inflicts disadvantage or damage due to the change in the terms of service, our company shall not assume any liabilities concerning said incident.

Article 3 (Matters on User’s Status and Restriction)

User Status
The user of “silkroad store” shall be deemed to have consented to this terms of service upon receiving (“receiving” in this section shall include browsing of information) any of the service being offered, and at the same time shall obtain the status as the user.

Restrictions on user
User may not engage in acts as listed below.

Use the service by posing as some other person. Designate the data link related to the service to other data etc. through method other then what is being approved by the “silkroad store”. Making illegal access to the data being stored in the computer being used for “silkroad store”, or act that destroys said data or potential thereof.

Act that interferes the operation of the service
Business activity that uses the service, use for the purpose of making profit, and use to prepare for said purposes, provided, however that it shall exclude the case whereby our company provides a separate approval.

To collect, accumulate the personal information of other users, or attempting to do so.

Act that violates the public order and other laws and regulations of Japan and other countries.

Article 4 (Interruption, Suspension of Service)

In the event of corresponding to any of the following reasons, through our company’s sole decision, our company may temporarily interrupt or suspend part or all of the service, without any prior notice to the user. Carrying out periodic or emergency maintenance/renewal of device and system that pertains to the service.

In the event of having a difficult time offering the service caused by force majeure such as fire hazard, electricity outage, natural disaster, etc. In the event the duty of type 1 carrier is not being provided.

Other operational or technical circumstance that requires temporary interruption or suspension of the service, or if our company determines that it is difficult to offers the service due to unexpected circumstance.

With respect to any and all disadvantage, damage incurred by the user or third party caused by the occurrence of temporarily interruption, suspension etc. on the offering of the service, irrespective of the reasons, our company shall not assume any liabilities.

Article 5 (Handling of Link)

Out of various services being offered by “silkroad store”, in the event of linking said services to other site, or if third party is providing the link to other site, our company shall not be liable in anyway concerning sites other than “silkroad store”.

In such case, our company in the same manner will not assume any liabilities regarding contents, advertisement, product, service, etc. that are covered under said site or can be used on said site.

Our company shall also be free from assuming compensations regarding any and all damages arising from or in connection with said contents, advertisement, product, service, etc.

Article 6 (Copyright)

Without the consent of the right holder, irrespective of the method, the user may not use any information being offered through “silkroad store” for reproduction, sales, publication and other purposes beyond the scope of personal use by the user himself/herself stipulated by the Copyright Law.

Without the consent of the right holder, irrespective of the method, the user may not allow third party to use or disclose to the public any information being offered through “silkroad store”. In the event a problem arises caused by a violation of the provision of this Article, the user shall resolve said problem with one’s own liability and expense, and shall not cause any problem or damage to our company.

Article 7 (Liability for Damages)

With respect to the damage incurred by the user or third party occurring from offering, delay, change, interruption, discontinuance, and suspension of the service, or disuse, leakage, fire destruction etc. of provided information etc., or occurring from other incidents related to the service, our company shall not be liable in anyway, provided, however, that with regard to the personal information being registered through the service, said information shall be handled pursuant to the separately prescribed “Handling of Personal Information”.

In the event the user inflicts damage on third party by the use of the service, said user shall resolve it through its own liability and expense, and shall not cause any damage to our company. In the event the user violates this terms of service, or if causing damage to our company by engaging in unjust or illegal act, our company may claim compensation for damages to said user that corresponds to said damage.

Article 8 (Privacy Policy)

The management and handling of the user’s information that our company became known in relation to the user’s usage of the service shall be pursuant to the Privacy Policy separately established by our company.

Article 9 (Governing Law)

The Laws of Japan shall be applied to the establishment, effect, performance and interpretation of this terms of service.

Article 10 (Agreement Jurisdiction)

In the event a dispute arises concerning this terms of service, the district court that has the jurisdiction over the location of our company’s head office shall serve as the agreement jurisdictional court of the first hearing.
